The Ministry of Electronics and Information Technology (MeitY) has officially notified the Promotion and Regulation of Online Gaming (PROG) Rules, 2026, which are scheduled to come into force on May 1, 2026. This marks a significant turning point for India's digital gaming sector, bringing clarity to an industry that has operated under a cloud of regulatory uncertainty for years.
What Are the PROG Rules 2026?
The PROG Rules are structured into 6 parts and 26 individual rules. They serve as the operational architecture for the PROG Act, 2025 — the landmark legislation passed by Parliament in August 2025. The primary objective is to protect Indian citizens, especially young people, from the financial and social harms of online money games, while simultaneously creating a clear and structured pathway for e-sports and social gaming to grow.
The Online Gaming Authority of India (OGAI)
One of the most important features of the new rules is the establishment of the Online Gaming Authority of India (OGAI) — a unified, multi-ministerial regulator headquartered in New Delhi. The OGAI operates as an attached office under MeitY and includes Joint Secretary-level representatives from the Ministries of Home Affairs, Finance, Information and Broadcasting, and Sports.
The OGAI's key responsibilities include maintaining a public blacklist of prohibited games, issuing registration codes for permitted platforms, handling player grievances, and coordinating with law enforcement agencies to ensure compliance.
How Will Games Be Classified?
At the heart of the new framework is the Determination Test — a structured assessment process that evaluates whether a game qualifies as a prohibited money game or a permissible social game. The test looks at factors such as whether a fee or stake is involved, whether the player expects monetary winnings, and how rewards or in-game assets can be redeemed.
Games that fail the determination test will be classified as prohibited money games and added to the OGAI's public blacklist. Games that pass will be eligible for registration as permitted social or e-sports platforms.
What Does This Mean for Indian Casino Players?
Under the PROG Act and its new rules, real-money online casino games — including slots, roulette, and card games where money is wagered — remain banned. International casino platforms that accept Indian players operate outside this regulatory framework, meaning players who use them do so at their own discretion.
However, land-based casinos in Goa and Sikkim continue to operate legally under state licensing regimes that predate the national law. For players in those states, physical casino gaming remains a legal option.
Key Mandatory User Safety Measures
The PROG Rules mandate a set of user safety measures that all registered platforms must implement. These include age verification, parental controls, session time limits, player grievance redressal mechanisms, and counselling support for users showing signs of problematic gaming behaviour.
Looking Ahead
The implementation of the PROG Rules does not end the legal battle. The Supreme Court of India is still scheduled to hear constitutional challenges to the PROG Act itself. Until that hearing concludes, the regulatory landscape remains in flux. Players and operators are advised to stay updated on developments from both MeitY and the Supreme Court.
